The coroner ruled it a homicide, but according to reports, the 67 yr. old swung at the employee first:

You sure it was the employee, and not the food?

Sometimes it's hard to tell the difference.

If they named their burgers after people on the bench, do you think it be "The Home of the Wapner"?

Put up yer dukes ya young whippersnapper! On second thought I could use a nap right now.
Beating down an old guy ain't too cool, but forgetting how old you are and swinging on a 20 year old ain't too good either. That kid will probably do a year and some probation for going too far with the old dude.

They'll probably fire the employee since the old dude didn't get to 'Have it his way'....Unless that's how he wanted it?

Justifiable homicide actually.

that really depends. If the young man used unreasonable level of force after the old man was unable to continue the fight, then he has comitted a crime. This is a possibility, so I guess its best to let those with more facts and details be the judge.
I think anything more than manslaughter due to the fact the suspect was not the belligerent party would be excessive.
